Welcome to the Shea website www.shea.com.sg (the “Website”). Your use of this Website is governed by these Terms and Conditions set out below. By using any part of this Website, completing your customer registration with us and/or placing an order on the Website you agree to be bound by the Terms and Conditions.

Eligibility
To be eligible to purchase goods on this Website and to lawfully enter into and form contracts on this Website under Singapore law you must register to use the Website and be the holder of a valid debit/credit card belonging to you. You also warrant that the personal information which you are required to provide when you register as a customer is true, accurate and current in all respects. You agree to be fully responsible for the accuracy of the details you provide and to update them as necessary through the “my account” page and you agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

This contract shall be concluded in English.

Placing an order and order acceptance
You place your order request for goods from the Website by clicking on the “Purchase” button at the end of the online ordering process. You will be guided through the process of placing an order by a series of simple instructions on the website. Once you have placed your order, we will send to you an acknowledgement providing you with a payment reference and the value of your order which has been debited. This will come via PayPal. This is not an order confirmation or order acceptance from The Old Factory Pte Ltd.

Unless we have notified you that we do not accept your order or you have cancelled your order in accordance with the Cancellation Section, our acceptance of your order and the completion of the contract between you and us will take place when we have dispatched the goods ordered by you. You may not cancel your order once it has been dispatched. If you do require information regarding your order(s) please contact Customer Services mentioned at the beginning of this document.

We may not accept your order if an item you have ordered is out of stock, unable to obtain authorisation for your payment or if we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time.
If we are unable to fulfil your order following our order acknowledgement, we will contact you by email or telephone as provided by you advising you of this. See Cancellation Procedure below.

Your account
By using the website you agree to keep your password and account details confidential, and to take all reasonable measures to prevent unauthorised access to your account. You are responsible for all actions that occur in relation to your account. If you have a reason to believe that your password has become known to somebody else, or is likely to be used in a way that is unauthorised by you, you should contact us immediately. If you forget your password, we will reset it upon your request and send it to the email address you registered with. All the personal information that you provide will be held in accordance with the Privacy Policy. Your account can be cancelled at any time by contacting Customer Services

Description of products
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct. Although we aim to keep the website as up to date as possible, the information including product descriptions and ingredients appearing on the Website at any particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted in accordance with our order acceptance policy.

Payment
All prices indicated for products available via the Website are exclusive of delivery charges. The total cost of your order is the price of the products ordered and delivery charges set out in the Delivery section of the Website. Payment is made via credit card via PayPal. All payments are subject to validation checks and authorisation by PayPal. If your payment is refused or not authorised for any reason, we will not be liable for any delay or non-delivery of goods.

Passing of property
We will retain the legal ownership of the goods until full payment has been made by you and such payment has been received by us. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.

Risk
Risk of the goods will pass to you on delivery to you

Delivery
We will deliver the goods to you in accordance with the delivery option selected by you during the order process. Any delivery timescales quoted to you are indicative only. Orders may be delivered in one or more deliveries. We not accept any liability whatsoever for delayed delivery caused by a third party. As soon as you have received the goods, you will assume all risk in the goods.

Acceptance
Upon receipt of the goods, you must inspect the goods immediately for good condition and order accuracy (in the presence of the delivery person if possible) and customer will be deemed to have accepted the order and the order delivered. If the goods are damaged or the order incomplete, the issue is to be communicated to Shea at admin@theoldfactory.org within 10 days of order placement or 3 days after goods are received, whichever being earlier. Shea will then investigate and offer a solution in whichever way Shea deems fair to both parties. Shea cannot accept exchanges after this period. Goods exchanged and original packing must be returned. Goods will be packed to minimise corner damages like dents and dings, however, these are to be expected and not grounds for refunds or exchange. Your statutory rights are not affected. If you have not received the entire order as detailed on the order acknowledgement email sent to you when an order is received, please contact our Customer Service.

Cancellation and returns procedure
Please note that you may not cancel this contract if the goods have been dispatched. Should you wish to cancel your order before it has been dispatched, please call Customer Services and refer to Return Policy.

Complaints
If you wish to complain about any matter in respect of the goods please contact Customer Services.

Accuracy of information
We attempt to be as accurate as possible when describing products on the Website; however, to the extent permitted by law, we do not warrant that the product descriptions, colours or other content available on the Website are accurate, complete, reliable, current or error free.

Samples
Any products and services, and any samples we may provide to you are for personal use only. You may not sell any of the products or services, and any samples you receive from us. If you wish to become a reseller, please contact Customer Services.

Nothing contained in these Terms and Conditions shall be construed as creating any agency, partnership or other form of joint enterprise between us.
